REGULAR BOARD MEETING
MISTY ACRES METROPOLITAN DISTRICT
Thursday 11/16/23
Meeting Time 6:00 p.m.

1. Call to Order
2. Roll Call: Board members Chet Sawyer, Andrew Bussa, Jamison Cleaver, Matthew Kirchoff, and
Julie Tetley. Also in attendance: Wendy Monteith, District Counsel, and District resident Dave
Donahue.
3. Chairperson Report:
• Sales Tax Exemption received and approved from State
4. Treasurers Report: An amended budget will need to be prepared for 2023; to address
increase of revenue from that budgeted; so River’s Development is owed additional funds for
2023 under the Reimbursement Agreement. Treasurer provided an update on the accounts.
5. 2024 Budget: The board considered the proposed budget for Misty Acres Metropolitan
District presented by Chet Sawyer. District Counsel states that notice of the budget hearing
and proposed budget were published in a newspaper with local circulation in El Paso County.
Andrew Bussa states that notice of the budget hearing and proposed budget were also
published on the District’s website. Julie Tetley moves to approve the 2024 budget presented
to the Board. Jamison Cleaver seconded the motion. The 2024 budget is approved by the
board members. A Resolution to Adopt the Budget, appropriate the funds, and to authorize
the District’s counsel to certify the District’s mill levy to El Paso County was approved and
signed.

• Sign: Improvements still in progress. Jamison Cleaver will sand and spray paint as
a mitigation measure.
• Bench vandalization: Jamison Cleaver will inspect the damaged bench to determine
if mitigation measures (cut and sand the damaged portion) can be preformed to
make the bench usable. Andrew Bussa reports that new metal benches are priced
at approximately $3500 each, plus necessary labor. Matter tabled until next
meeting.
• Trail Damage: Following up on utilities located too close to trail for landscape company
to preform mitigation culvert work as a solution for washouts of trail sections. The
Board reviewed engineering company option suggested by residents; former directors,
and board members, Board will continue to follow up on suggested workers/engineers,
weather permitting. Jamison Cleaver suggested that Board consider looking at adding
blacktop to washout areas if digging cost prohibitive; Jamison will look into that further
and report to Board. Board will continue to explore and price options.
• Open Space Use and Rules: Legal Counsel reports that District has the right to
create open space use rules, and that fines may be assessed for violation of same
provided rules are published in advance. Committee will present suggested rules to
Board at future meeting.
• Downed Tree: Matter tabled currently, as a survey would need to be preformed
to confirm tree removed by resident was on District owned property. Matter tabled.
• Nextdoor Account: Julie Tetley reports she was unable to set up a District account
with Nextdoor without a provable address within District. Options discussed, Board
determined that continuing current setup of Julie or other Board member posting from
their personal Nextdoor Account was sufficient until an easier solution could be found.
7. New Business:
• Weed Mitigation: Chet Sawyer provides update on status of work to remove noxious
weeds from District Parcels, to comply with El Paso County’s notice of same. Company
hired but work does not appear to be performed; but winter weather makes it unclear
of status of noxious weeds. He will follow up to make sure company is hired in spring to
spray/kill noxious weeds. On Counsel’s recommendation, Chet will also provide status
update to County that matter being addressed.
