REGULAR BOARD MEETING MISTY ACRES METROPOLITAN DISTRICT
Thursday May 25, 2025 Meeting Time: 6:00 p.m.

- Call to Order: 6:00 pm.
- Roll Call and Oaths of Office: Andrew Bussa, Matthew Kirchoff, Jamison Cleaver, and Jonathan Baker Present. Newly elected directors Andrew Bussa, Jamison Cleaver, and Jonathan Baker are sworn in and take Oaths of Office by District Counsel Wendy Monteith, as notary. David Donahue absent; his oath will be given later upon his return to town.
- Approval of Minutes: Board approves prior meeting minutes from February 2025.
- Chair Report:
- Audit Exemption Application approved by State Auditor.
- With the Exemption Application properly filed and past revised exemption reports filed, tax payments are again being received from the county assessor.
- Treasurer Report: Treasurer David Donahue not present; in his absence Andrew Bussa reports that the current balance is $232,484.29. Expenses paid include $8,100 to Kerr (details discussed below in old business), $100 for the surety bond premium (as required by statute), and $3,000 for the accounting firm who prepared and filed the audit exemption.
- Old Business:
- Water Line replacement by Woodmoor Water: The district property disturbed by construction still needs landscaping completed. Jamison Cleaver will follow up with Woodmoor to ensure this is completed.
- Trail Work: Kerr was able to complete trail remediation work, repair of the Misty Acres sign, and tree trimming; so payment was released.
- Webform address: Chair Bussa continues to monitor; nothing relevant to District has come through at this time.
- Mowing and Spraying: Mowing and spraying of area is ongoing for spring/summer season.
- New Business:
- New Development Petition for Exclusion: Monument Ridge East has filed a Petition for Exclusion of their property (the new development approved by El Paso County) from the Misty Acres Metropolitan District; to allow the new development to have their own metro districts with their own taxes on the new development property. Petition set for hearing before the board at the next regular board meeting on August 21, 2025.
- Open Space Damage:
- A landscaper/contractor’s truck was discovered driving on trails; signs needed to mitigate against improper use of open space.
- Tree and grass damage was discovered in the open space near fenceline of a residence; appears that a resident may be weed spraying. Board moves to approve up to $1,000 to perform a survey of open space area near damage to confirm property line; survey will also include line of open space that abuts the new development to confirm property line.
- Trail Usage: Board raises concerns with public use from new development of Misty Acres Trails if the property is excluded from District, and concern with wear and tear by individuals who are not obligated to pay for maintenance and improvements. If exclusion granted, board will look at options to discourage/limit use by nonresidents.
- Mailbox: Jon Baker agrees to take responsibility for the PO Box and checking mail; PO Box key given to his custody.
